I need bankruptcy advice.?
I am thinking about filing for bankruptcy and I am unsure if I really want to go that route. I have debt, not a tremendous amount but we all know what this economy is like. I have been current on all my bills until these last few months. I am not in a position to get caught up any time soon and am also not looking to make any big purchases car, house, etc. within the next few years. I want to know what people think that have gone that route and how long it takes to recover from filing. I already have a poor credit rating and I am not extremely concerned with it getting lower. Any advice?

This is really embaressing but i'm 20 years old with 2 credit cards. My second credit card was a complete joke, it had a 200 limit and right away i only had abut 30 dollars as an available balance. I havent been up with payments and now that credit card is almost at 600 dollars. the first credit card i had, had about a 500 dollar limit and is up to about 800 dollars. Im so stressed out I have no idea what to do, i feel like the minimum payments just do much good. Is it smart to file for bankruptcy, what do i do? Who do i talk to?Please please, any help is so much appreciated thank you.

Anyone provide bankruptcy advice?
I'm actually considering filing bankruptcy cause there is several debts that i just don't have the money to pay anymore. I do have a couple of questions about this situation. First I don't believe I will be able to file Chapter 7 The one where you don't pay back, right? I think thats right. Because the fact I haven't a clue where to start and at that I haven't been able to pay on any of the debts i have.So I figured I'd try for Chapter 13, I have been in Bankruptcy before, its not a good thing but i have shaped up my finance statements better but i'm still in a hole. First the house we currently live in is not in our name but is in our parents name so basically we are doing like a lease or renting.Second we have two cars, 1 which we just recently acquired that we are paying on from a dealership the second one is one that we got after a trade and that we just pawned the title to try and help pay some bills.If I did file Chapter 13 would i lose either car or the house or anything like that?I am due in court for a debt i owe to a previous company that is suing me for the money which I so don't have.Can anyone please help me? Just sitting here typing this upsets my well being...

Help need Chapter 7 bankruptcy advice?
We are filing chapter 7. We own and live in one home but have a mobile home that is being paid on by brother in law but is in our name as well as 1 3 ownership in a little over 3 acres the mobile sits on it . The 3 acres is a life estate and lists his brother and sister as owners too. First lawyer said that it was safe, but now says we have to let it go in the bankruptcy throwing my brother and sister in law out of their homes. the land still has a 6000 lien on it owed to his parents payable in $25 per month for 20 years only been 9 . their lawyer is trustee, his parents overseers and us as inheritants of the property at the end of 20 years. Can the courts actually take this and force his brother and sister off? Please I need a answer asap.

Can someone please give me some bankruptcy advice for filing in California?
I'm an unemployed teacher and have just lost my car my only asset and am representing myself in my bankruptcy. My combined debts assuming I'll still owe about $6,000 on my car once it sells at an auction is approximately $12,000. I do not have a savings and no longer have retirement accounts because I had to cash them out to cover living expenses. Twelve years ago I had to file bankruptcy and am concerned about how that will look to the judge. I worked to earn my college degree since then and was doing well when suddenly I found myself without a job. Any thoughts on that? My debts back then were fully discharged, and I'm hoping to file a Chapter 7 for another discharge of my debts. Here are some of my questions, any input would be appreciated 1 Is there any kind of assistance available for people who cannot afford the filing fee?2 Once I file, how long can I expect for the court date?3 Does the online bankruptcy class that is required cost anything?4 Can my $650 debt to the IRS back taxes be included or just the interest and penalties?5 Any suggestions for someone doing this without an attorney?I've done my research and am actively seeking answers to my questions, but there are some very informed and helpful people on this site, so for peace of mind I really welcome your input. Need bankruptcy advice, please help!?
I was starting to get over my head with my credit cards general cost of living and I was never late on any of my payments. I signed up with what I thought was a debt consolidation, but what ended up being a debt settlement program. When signing up with this, I was told to stop making payments to my creditors altogether, so I did. One of the credit cards that I had did not want to settle and they issued a judgment against me. I wasn't able to try to work out payment arrangements personally because the debt settlement had the power of attorney on the account and the creditors wouldn't talk to me. Well now the creditor is asking for the full amount that is owed which is now about 3,000 more than what I initially put on the card from late fees and such. Either that or the payment plan that they are asking for is more than what I make in a month I have a low income . It seems that they are making it to where I have no choice but to have them garnish my wages, which I don't want or file for bankruptcy which I definitely don't want. I don't know what to do and I can't afford a lawyer to speak on my behalf. Any suggestions would be very much appreciated. Thanks in advance.

I have a terminal disease and I have some debt that I am never going to be able to get a hold of. I am going to have to file bankruptcy. I am bed ridden right now. I need to get some advice on some questions I have. Can anyone help me?I am married and our house is in my wife and my fathers name, not mine. All the debt, medical and Credit card are all in my name and nobody else. So I will file bankruptcy myself. I have no assets, no job, nothing like that. I actually have less than 10 debtors. I cannot afford an attorney because my wife works to care for me and our three boys and she makes 10.00 an hour. Has anyone used the on line bankruptcy paper filing services at all? Is this something that can be done? Is it hard? any advice would be appreciated. I really need some help. Thanks

Got injured, lost job, got depressed, deep debt, started drinking, went through recovery in March, got my act back together, now working on cleaning up the mess. Big monkey on my back needs to go. Only own a car. Everything else is gone. Owe credit card companies as well as state taxes and IRS. Not working, just volunteering. Made appointment with attorney for Feb 2. Would like to know more about what my options are. Have no money, just intense desire to get back on track.

Chapter 13 bankruptcy advice?
my chapter 13 case was recently dismissed not discharged in december. i was about half way through my plan payments and had 2 years remaining. i stopped making my payments because i was fired from work...can i file chapter 7 to have the remainder of the debt from my ch. 13 $25K? Thanks.

Thinking about bankruptcy, advice much appreciated!?
Me and my wife recently separated and have not officially divorced yet. Her name is on the deed since we signed her on, but the loan is under my name alone. Now that I have the house myself I can barely make the mortgage, and can not afford to keep going like this. I have been trying to sell the house the last three months at a break even price in SLC, UT, and no luck and not even an offer. I don't know if I would be able to afford it even if I got some room mates. I have spoken with an attorney and they said that my best option would be chapter 7, but how would that compare to just giving the house back to the bank?And finally, my X wife is afraid it will hurt her since we are still married and her name is on the deed. I didn't think so since the loan is just under my name, but she was also concerned about it looking bad to the courts and me losing any kind of custody over our two year old. We are planning on doing an uncontested divorce. Any advice would be great
